New Schedule of Sales of WAV Medallions – Reminder

Reminder To All Interested Parties:

On June 28, 2016, the Philadelphia Parking Authority Board issued the attached Order entered at Docket No. 16-001 (Download Board Order 16-001) authorizing the Taxicab and Limousine Division (“TLD”) to administer the sale of 41 wheelchair accessible vehicle (“WAV”) medallions beginning on October 5, 2016 with new directives as outlined.  Notice of this Order was published in the Pennsylvania Bulletin on July 9, 2016. Please also refer to the TLD Regulations 52 Pa. Code §§ 1013.31 – 1013.37 relating to Medallion Sales by the Authority.

Also attached for your reference is Form No. MA-1 “Bid Cover” (Download Form MA-1) that must be submitted by a bidder in its sealed bid in accordance with the TLD Regulations on the dates and times outlined in the Order along with all required supporting documentation.  Lastly, if a proposed bidder does not currently own a medallion taxicab certificate of public convenience (“CPC”), that person must file a Form No. SA-1 “Sale Application” (see 52 Pa. Code § 1027.6 relating to application for sale of transferable rights) to apply for a medallion taxicab CPC no later than 30 days prior to the scheduled bid date to qualify as an eligible bidder for the WAV medallion sales.  For example, SA-1 applications for proposed bidders to participate in the October 5, 2016 sale must be filed no later than 4:30 p.m. on Tuesday, September 6, 2016.  The SA-1 application may be obtained on the TLD’s website at http://www.philapark.org/resources-and-forms/.

Taxicab Safety Cameras – Second Notice to Contract Holders

Notice to All Interested Parties:

Pursuant to Commonwealth Court Judge Friedman’s June 29, 2016 ruling in Black Point Taxi, LLC et al. v. Philadelphia Parking Authority (76 MD 2015), affirming the Safety Camera Regulation, the Taxicab and Limousine Division (“TLD”) is now moving ahead with the process of ensuring that all taxicabs are in compliance with the Regulation by obtaining and installing an approved safety camera system.

The TLD will immediately proceed with requiring installation by all medallion owners who have previously submitted contracts for approved camera systems during the initial wave of inspections (October 15, 2015 – December 2, 2015) but have not yet had them installed. Accordingly, any medallion owner who had previously submitted a contract but fails to appear for a safety camera inspection with an approved camera system on or before November 2, 2016, will be in violation of the Regulation and will receive a citation (just as those owners who did not appear with an installed system or contract during the initial wave of inspections).

For your convenience, a schedule for inspections is attached here (Contract Holders Inspection Schedule 8.11.16).  Upon installation of your system, please contact Lance Lepchuk at 215-683-9656 or [email protected] to confirm your inspection appointment.

Appointments for safety camera inspections are made from 7:00 AM to 6:00 PM, Monday through Friday. Safety camera inspections may not be permitted for this group of affected owners after 90 days from the date of this notice. Therefore, please plan to have your system installed as soon as possible to adhere to this deadline. You will need to contact the company that you contracted with for your approved safety camera system. A schedule will follow shortly for the rest of the industry – those owners who to date have neither installed an approved system nor produced a contract – to appear for an inspection of a compliant safety camera system.

Transportation Network Service Temporary Authorization

To All Interested Parties:

On July 26, 2016, the Philadelphia Parking Authority Board issued an Order and Interim Guidance statement at Docket No. 16-002 (Download Board Order No. 16-002).  Pursuant to Act 85 of 2016, the Authority is the sole regulator of a new classification of commercial motor vehicle transportation service in Philadelphia provided by each carrier referred to as a “Transportation Network Company” (TNC). Therefore, the purpose of the attached Order is to provide guidance regarding the manner in which the Authority will regulate this new service, the authorization of which is set to expire 64 days from the date of the Order.

Notice of this Order will also be published in the Pennsylvania Bulletin.
