Notice to All Concerned: Fuel Surcharge
On April 23, 2012 the Board of the Philadelphia Parking Authority, at its scheduled April meeting passed a resolution requiring all medallion and partial rights taxicabs serving the City of Philadelphia to charge passengers a $1.25 per trip (not per customer) fuel surcharge, effective May 1, 2012. VTS and CMT are taking steps to automatically update the meters to include the $1.25 fuel surcharge as of 12:01 AM on May 1, 2012.
The partial rights taxicabs are responsible for having the surcharge placed on their meters by May 1, 2012 at 12:01 AM. Once that is done they are required to contact the TLD Enforcement Department to have their meters sealed.
The surcharge will remain in effect until midnight on Thursday May 31st, 2012. The June surcharge, if needed will be determined on Friday May 18, 2012 and posted on the TLD site. This process will be repeated monthly using the third Friday of each month as the determining date for the amount of the surcharge.
The Resolution also authorizes the Airport Transfer services to charge $2.75 per customer for trips to or from the Philadelphia International Airport, effective May 1, 2012 at 12:01 AM. The amount of each monthly surcharge will be posted on the TLD site in a similar fashion to the taxicab surcharge.

The price per gallon for gasoline has been climbing steadily over the past few months. Fuel prices across the region are now averaging $3.89 for regular and $4.14 for premium gasoline. One week ago, the price of regular gasoline in our area was $3.85, one month ago it was $3.76 and one year ago, just before the most recent fuel surcharge was approved by the Philadelphia Parking Authority (PPA), it was $3.58.
On March 28, 2012 the Taxi Workers Alliance of Pennsylvania (TWA) filed a petition and Fuel Surcharge proposal with the Taxicab and Limousine Division (TLD) of the PPA requesting that a surcharge be implemented. The proposal, which is posted below for review and comment, describes a sliding scale at which the first surcharge is ‘triggered” when gasoline reaches $3.50 per gallon of Regular Gasoline and increases commensurately by.50 cents with each .50 cent increase in the price of Regular gasoline. The proposal calls for an additional .50 cents on top of the base surcharge for trips to and from the Philadelphia International Airport.
A simpler but more comprehensive approach is the Pennsylvania Public Utility Commission’s (PUC) procedure for implementing on going fuel surcharges which has been under consideration by the PPA since receipt of public comments last Summer praising the system. The PUC fuel surcharge system and implementation procedure, which is posted below, has been in effect for a number of years. It provides for a much greater degree of consistency and predictability in addressing what has become a very problematic and costly aspect of making a living as a call or demand/for hire transportation driver. The system allows fuel surcharges to be implemented or repealed on a monthly basis without the need for the inherent delays of emergency petitions, comments, investigations and hearings.
Accordingly, the Philadelphia Parking Authority invites public comment with regard to the need for a fuel surcharge and for comments as to the best way to implement a sliding scale surcharge. The proposed surcharge applies to all medallion and partial rights taxicab trips as well as airport transfer service under Philadelphia jurisdiction.
The surcharge system selected and implemented by the Authority will need to be one which may be electronically implemented and repealed by all vendors of meter technology systems approved by the Authority’s TLD.
Partial Rights Taxicabs will need to adhere to the terms and schedule concerning any surcharge method selected and approved but will need to have their meters manually updated and sealed at TLD Headquarters with regard to surcharge addition and removal.

The Authority has received several complaints about taxicab drivers who have refused to accept credit card payments for fares of less than $10.00. There is no law or regulation that permits a Philadelphia taxicab driver to refuse to accept credit card payments, regardless of the amount of the fare.
Refusal of a credit card payment for a taxicab fare remains a violation of the Authority’s regulations. See 52 Pa. Code §1021.11 (d).

SUBJECT: Draft Proposed Wheelchair Taxicab Regulation
When reviewing or commenting upon the Draft Proposed Wheelchair Taxicab Regulation that the TLD has published for comment, please remember the following:
- This regulation will eventually have to be submitted to the Pennsylvania Independent Regulatory Review Commission (“IRRC”) and adhere to state agency rulemaking requirements.
- This is a DRAFT PROPOSED regulation. Every part of the Draft Proposed Wheelchair Taxicab Regulation is subject to change, including the use of a lottery system and the number of medallions that must be wheelchair accessible.
- The reason the TLD is asking for preliminary public comment is to develop the best version of this regulation that we can. This is not the final version of the regulation. We need your help and advice in this process!
- We previously advised you that there is a separate Federal Court action pending that may result in an Order that deals with this issue. We urge you to consult an attorney and consider joining this litigation to protect your rights. The docket number is USDC Civil Action No. 2:11-cv-04692-CDJ.

In order to provide the greatest measure of access and convenience for those who wish to attend the public comment hearing scheduled for February 15 at 10:00 AM regarding the proposed regulation establishing wheelchair accessible taxicabs, the location of the hearing has been changed from PPA- TLD Headquarters in South Philadelphia to the Pennsylvania Convention Center, 12th and Arch Streets, Room 108AB.

PPA Proposes Regulation Requiring Wheelchair Accessible Cabs
300 cabs to be wheelchair accessible by end of 2012 – all cabs by 2016
(PHILADELPHIA) – Philadelphia Parking Authority Executive Director Vince Fenerty today announced that, “the PPA has begun the process to require more than 300 taxicabs in Philadelphia to become wheelchair accessible before the end of this year.”
Under the draft regulation issued for public comment yesterday, 300 taxicabs will be required to be wheelchair accessible this year, and all taxicabs will be required to be wheelchair accessible by January 1, 2016.
According to Fenerty, “attempts over the past several years to encourage taxicab owners to voluntarily provide accessible taxicab service have resulted in only 3 active wheelchair accessible taxicabs in all of Philadelphia.”
“We can no longer wait for taxi companies to voluntarily step up and address the needs of our disabled individuals. We must address the need for accessible taxicab service in Philadelphia now,” Fenerty said.
“Our draft regulation outlines the process for the eventual conversion of the entire taxi fleet in Philadelphia. That regulation will have to go through all of the Commonwealth of Pennsylvania’s review procedures that apply to a Commonwealth agency,” Fenerty said.
Under the draft regulation, 300 medallion taxicabs would be selected through a lottery system. Those 300 medallions could then only be attached to wheelchair accessible vehicles. The lottery would occur this year. Also, 20 percent of the fleet of any non-medallion taxicab company would also have to be wheelchair accessible this year. The vehicles used to provide wheelchair accessible service will need to comply with the requirements of the Americans with Disabilities Act.
