Request for Comments concerning the Fiscal Year 2013 TLD Budget and Fee Schedule and Notice of a Hearing

Attached please find the Philadelphia Parking Authority, Taxicab and Limousine Division’s (TLD) Fiscal Year 2013 Budget and Fees for your review and comment. We would greatly appreciate any written comment you may have by close of business on Thursday, February 23, 2012. Comments may be forwarded to Charles Milstein, Assistant to the Director at cmilstein@philapark.org or at the address of the TLD below.
Additionally, a public comment hearing will be held at the offices of the TLD, 2415 S. Swanson Street in Philadelphia on Thursday, March 1, 2012 at 10:00 AM.

SUBJECT: Draft Proposed Wheelchair Taxicab Regulation
When reviewing or commenting upon the Draft Proposed Wheelchair Taxicab Regulation that the TLD has published for comment, please remember the following:
- This regulation will eventually have to be submitted to the Pennsylvania Independent Regulatory Review Commission (“IRRC”) and adhere to state agency rulemaking requirements.
- This is a DRAFT PROPOSED regulation. Every part of the Draft Proposed Wheelchair Taxicab Regulation is subject to change, including the use of a lottery system and the number of medallions that must be wheelchair accessible.
- The reason the TLD is asking for preliminary public comment is to develop the best version of this regulation that we can. This is not the final version of the regulation. We need your help and advice in this process!
- We previously advised you that there is a separate Federal Court action pending that may result in an Order that deals with this issue. We urge you to consult an attorney and consider joining this litigation to protect your rights. The docket number is USDC Civil Action No. 2:11-cv-04692-CDJ.

To all concerned parties:
In order to provide the greatest measure of access and convenience for those who wish to attend the public comment hearing scheduled for February 15 at 10:00 AM regarding the proposed regulation establishing wheelchair accessible taxicabs, the location of the hearing has been changed from PPA- TLD Headquarters in South Philadelphia to the Pennsylvania Convention Center, 12th and Arch Streets, Room 108AB.
Attached below is a copy of the Authority’s public meeting participation policy. The policy lists several rules and guidelines with which we would appreciate your compliance when contributing your comments at the hearing on 2-15-12.

In order to make taxicabs in all parts of Philadelphia more accessible to people with disabilities, the Authority proposes the following amendment to its regulations. PPA Proposes Regulation Requiring Wheelchair Accessible Cabs
300 cabs to be wheelchair accessible by end of 2012 – all cabs by 2016
(PHILADELPHIA) – Philadelphia Parking Authority Executive Director Vince Fenerty today announced that, “the PPA has begun the process to require more than 300 taxicabs in Philadelphia to become wheelchair accessible before the end of this year.”
Under the draft regulation issued for public comment yesterday, 300 taxicabs will be required to be wheelchair accessible this year, and all taxicabs will be required to be wheelchair accessible by January 1, 2016.
According to Fenerty, “attempts over the past several years to encourage taxicab owners to voluntarily provide accessible taxicab service have resulted in only 3 active wheelchair accessible taxicabs in all of Philadelphia.”
“We can no longer wait for taxi companies to voluntarily step up and address the needs of our disabled individuals. We must address the need for accessible taxicab service in Philadelphia now,” Fenerty said.
“Our draft regulation outlines the process for the eventual conversion of the entire taxi fleet in Philadelphia. That regulation will have to go through all of the Commonwealth of Pennsylvania’s review procedures that apply to a Commonwealth agency,” Fenerty said.
Under the draft regulation, 300 medallion taxicabs would be selected through a lottery system. Those 300 medallions could then only be attached to wheelchair accessible vehicles. The lottery would occur this year. Also, 20 percent of the fleet of any non-medallion taxicab company would also have to be wheelchair accessible this year. The vehicles used to provide wheelchair accessible service will need to comply with the requirements of the Americans with Disabilities Act.

The Final Rulemaking Order and Regulations (PRM -10-001) have been published in the Pennsylvania Bulletin (41 Pa.B 6499). The Regulations are effective December 3, 2011.
