June 2013 Fuel Surcharge
On April 23, 2012 the Board of the Philadelphia Parking Authority, at its scheduled April meeting approved a measure implementing a fuel surcharge system for all Philadelphia Taxicabs and Airport Transfer Services, (a category of limousine service largely provided in vans).
The surcharge system allows for the fuel surcharge to change monthly based on fluctuating gas prices as described in the chart posted with the Board Resolution of April 23, 2012 (see link for chart on this page at December 19 Posting).
As required in the April 23, 2012 Resolution, the average price per gallon of regular, unleaded gasoline must be evaluated each month, the corresponding surcharge determined and then posted on the Taxicab and Limousine page of the Authority’s website on the third Friday of that month for the following month.
Accordingly, based upon an average price per gallon of regular gasoline in May 2013 of $3.51, the fuel surcharge for June 1, 2013 through June 30, 2013 is as follows:
For Taxicabs – $1.00 per trip.
For Airport Transfer Services (as described above) – $2.25 per passenger.

Maximum Taxicab Lease Amounts
The Taxicab and Limousine Division has received questions regarding the maximum amounts to be charged in taxicab lease agreements. To clear up any misunderstandings the maximum amounts as of this date are:
These maximum lease amounts were established by the Authority on March 25, 2008 after a lengthy investigatory process and in compliance with 53 Pa.C.S. § 5720.

These maximum taxicab lease amounts were developed through an Authority wage investigation conducted in compliance with 53 Pa. C.S. 5720 (c). In September, 2007, the Board of Directors authorized the TLD to conduct a review of taxicab rates and leases. Consequently, a rate proposal was issued on December 7, 2007 by the TLD. Comments were received during the comment period of December 7, 2007 to December 28, 2007, and at a public hearing on January 17, 2008. On February 25, 2008 a proposal was submitted to the Board for review with a recommendation for adoption effective June 2, 2008. On March 25, 2008, at an open meeting the Board unanimously adopted the proposal, including the above referenced maximum taxicab amounts.
TERM OF LEASE
Some medallion owners are attempting to circumvent the Boards intent by charging the “daily” lease rate for seven individual days payable once a week with the same exact weekly payment requirement as a “weekly” lease. The Enforcement Department rejects this reasoning and may cite violators.
COMPLIANCE
A copy of the lease, as required in §1017.6 “Required documents” must be presented at bi-annual inspection and will be reviewed for compliance.

Permanent or temporary authority to render services as a common carrier in the City of Philadelphia has been filed with the Philadelphia Parking Authority (PPA) Taxicab & Limousine Division (TLD) at Docket A-13-03-12 by the below named applicant. The company has applied to transfer the rights held by Micky Cab Corp. (CPC No. 1000566-01, Medallion P-1190 & P-1306), to transport persons in taxicab service between points within the City of Philadelphia and from points in the City of Philadelphia to points in Pennsylvania, and return.
Formal protests must be filed in accordance with 52 Pa. Code Part II (relating to public utilities). Filings must be made at the offices of the TLD with the Clerk, 2415 S. Swanson St., Philadelphia., PA 19148, with a copy served on the applicant by May 6, 2013. Documents filed in support of the application are available for inspection at the TLD office (Contact Charles Milstein) between 9:00 a.m. and 4:30 p.m. Monday to Friday or may be inspected at the business address of the applicant. A Message To Taxicab and Limousine Owners concerning the Powertrain Control Module (“PCM”)
The PCM is an automotive component that controls more than 100 factors in a car or truck. Its purpose is to monitor the many hundreds of error codes that can occur and indicates through a “Check Engine Light” that some subsection of the car is experiencing a problem.
The PCM is one of several onboard computers, and is essentially the “brain” of the engine control system.
The PCM also tracks the vehicle’s mileage, an issue that often controls the eligibility of a vehicle to provide taxicab or limousine service.
The PCM should be replaced only when it is diagnosed to be defective because it also contains a unique serial number and controls the odometer.
The TLD’s inspection process will now include a diagnostic review of the PCM’s status.
IMPROPERLY REPLACING A PCM may disqualify your vehicle from entry into service as a taxicab or limousine. You should report the replacement of a PCM in any vehicle currently authorized to provide taxicab or limousine service to: Robert Hager, Deputy Manager of Inspections, 215-683-9447 or Rhager@Philapark.org. You must disclose the presence of a replacement PCM in any vehicle upon presentation of a vehicle for inspection.
Alert To Parents as the Prom and Graduation Season Approaches
As we approach spring, many families are busy preparing for Proms and Graduations. A key part of your preparations may be making transportation arrangements. In that regard, the Philadelphia Parking Authority (Authority) wants to help safe guard your loved ones from illegal limousine operators.
Limousine carriers operating between points within Philadelphia are regulated by the Authority. Trips between points in the City and points within the Commonwealth may also be regulated by the Public Utility Commission.
If the deal sounds too good to be true it probably is. Don’t trust your loved ones and their once in a life time moments to unregulated and under insured carriers. Properly licensed carriers use first class vehicles that have undergone rigorous inspections. These licensed companies use only certified drivers who have undergone a detailed vetting process.

Notice to All Industry Members
The Taxicab & Limousine Division (TLD) has recently discovered that broadcast email messages to industry members are not always being transferred to and received by all Yahoo email accounts. In an effort to control spam from reaching its users email accounts, Yahoo has a policy that does not allow the delivery of an email message that is sent from one email address to more than a certain number of Yahoo email accounts at one time.
Pursuant to TLD Regulations, all certificate holders, brokers and those regulated parties that have voluntarily registered an email address per Section 1001.51(c) are required to have a valid working email account to accept service by the TLD. Therefore, you are advised to use email accounts that are capable of receiving mass broadcast email messages from the TLD. You are responsible for assuring that your email account is capable of performing in the commercial manner necessary to be a regulated party as Yahoo may not be the only email service provider preventing mass broadcast messages from being delivered.
Therefore, for those regulated parties that currently have a Yahoo account registered with the TLD, you now have 15 days to register a new email account. This must be done by filing a Change of Information Form which can be found on this website under “Forms & Lists”. For those that use other email service providers, please check the terms and conditions of the provider’s email service and look out for changes in the future. Failure to have a valid working email address registered with the TLD may result in the issuance of a penalty.

Notice to All Industry Members: EFFECTIVE MONDAY, MARCH 4, 2013
All applicants for driver certification must be able to sufficiently speak in the English language to communicate with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries and to make verifiable entries on reports and records (see 52 Pa. Code §§ 1021.4 & 1057.4). Therefore, an application for new driver certification (DR-1) may only be filed upon proving proficiency in the English language.
All persons applying for new driver certification must first prove their ability to sufficiently speak in the English Language. English Proficiency examinations will only be given Monday through Friday between 8:30 a.m. to 11:00 a.m.
Only after passing an English Proficiency Examination may a person file a New Driver Certificate Application (DR-1) at the TLD Customer Service Window. The TLD Customer Service Window will only accept the filing of a DR-1 Monday through Friday between 8:30 to 12:00 p.m.
This process applies to all DR-1 new driver certificate applications, regardless of the classification (taxicab, limousine or dual certification). If you have any questions or need further clarification, please contact the TLD at (215) 683-9458 or at tld@philapark.org. Thank you.

USE OF ATTORNEYS BY INDUSTRY MEMBERS
The TLD’s Regulations require the use of a certified Broker or licensed attorney for some transactions before the Authority. However, the Enforcement Department strongly recommends that you seek the advice of legal counsel before approving or signing stock transfers, medallion or certificate transfers, management agreements, powers of attorney and other documents affecting your rights.
The Enforcement Department has received numerous complaints from industry members about these issues after the documents have been signed. The use of an attorney prior to signing those documents may have prevented the complainant’s problems and saved both time and money.

Pending the final adoption of the proposed rulemaking or further modification by this Board, it will be the policy of the Authority to adhere to the scope, practice and procedures provided in Annex A ofthe Proposed Rule Making Order dated January 28,2013 under Docket No. 126-3 when exercising any impoundment authorization under the act.

Please be advised that a public comment hearing has been scheduled for Wednesday, October 3rd at 10:00AM in Room 108 at the Pennsylvania Convention Center, 12th and Arch Streets in Philadelphia.
This hearing has been scheduled in order to receive further comment as to suggestions for regulations to implement a successful Wheelchair Accessible Taxicab Program in Philadelphia. As only five sets of written comments were received regarding this issue during the recently concluded comment period which ended on September 7th, we believe it necessary to establish a forum where those who prefer to do so may offer verbal comment in the presence of other interested parties. In addition, the period for PPA-TLD acceptance of written comments has been reopened and will extend until the 10/3 hearing date.
In accordance with our original request for information and comments of August 30, 2012 posted/attached immediately below, we are interested in obtaining input from all stakeholders of wheelchair accessible taxicab service in Philadelphia.

REQUEST FOR INFORMATION AND COMMENT FROM THE TAXICAB AND LIMOUSINE DIVISION OF THE PHILADELPHIA PARKING AUTHORITY CONCERNING PENNSYLVANIA ACT 119 OF 2012
Act 119 (formerly HB 2390) which is attached below, was signed into law by Governor Corbett on July 5, 2012. Among the several provisions enumerated in the Act, it provides for immediate issuance for sale of 15 new medallions to be placed only on wheelchair accessible taxicabs with 15 additional such medallions to be sold annually for the next ten years for a total of 150 medallions slated for wheelchair accessible taxicabs in Philadelphia. The Act also provides for establishment of a wheelchair accessible taxicab driver training and certification program with substantial incentives for qualified drivers to participate.
The Philadelphia Parking Authority (PPA) is now tasked with establishing the regulatory framework for launching and maintaining a safe, reliable and robust system for supply of wheelchair accessible taxicab service to those individuals who need it, when and where they need it. While we feel confident we will be able to do this in a timely manner, we realize that we cannot do it alone and are seeking assistance through input from multiple entities whose areas of expertise or personal experience focus on at least some aspect of provision of this form of transportation.
Accordingly, the Taxicab and Limousine Division of the PPA seeks information and comment from the public at large, including the community of people with disabilities as well as from taxicab and limousine industry members concerning not only the issues specifically described below but any others that those commenting believe need to be considered.
We welcome comment from all concerning initial sale and/or distribution of the WAV medallions whether that be by public auction or by competitive bid through submitted proposals for all fifteen medallions annually or some increment thereof over time.
We are also interested in hearing everyone’s thoughts concerning the optimal method for dispatch of W A V taxicabs given our current industry makeup which includes 14 Certified Dispatchers for our current total of 1600 medallion taxicabs.
We are keenly interested in hearing from vendors of wheelchair accessible vehicles (WAV’s) suitable for taxicab service, WAV retrofit services and distributors of related equipment. We want to hear from those entities providing training programs for W A V drivers and regulatory/inspections staff. We seek input from vendors of software and payment programs for channeling governmental funds provided to people with disabilities for transportation in taxicabs.
Finally, we are very interested in hearing from taxicab and limousine regulatory bodies in other jurisdictions where wheelchair accessible taxicab programs have already been implemented.

MAXIMUM TAXICAB LEASE AMOUNTS
The Taxicab and Limousine Division has received questions regarding the maximum amounts to be charged in taxicab lease agreements. To clear up any misunderstandings the maximum amounts as of this date are:
Maximum Leases Vehicle Supplied by Medallion Owner Vehicle Supplied by Driver 12 – Hour Shift $70 NA Daily $95 $70 Weekly $570 $420 These maximum lease amounts were established by the Authority on March 25, 2008 after a lengthy investigatory process and in compliance with 53 Pa.C.S. § 5720.

Permanent or temporary authority to render services as a common carrier in the City of Philadelphia has been filed with the Philadelphia Parking Authority (PPA) Taxicab & Limousine Division (TLD) by the below named applicant. The company has applied to transfer the rights held by Lalla Trans, Inc. (CPC No. 1026665-01, Medallion No. P-0003) to transport persons in taxicab service between points within the City of Philadelphia and from points in the City of Philadelphia to points in Pennsylvania, and return.
Formal protests must be filed in accordance with 52 Pa. Code Part II (relating to public utilities). Filings must be made at the offices of the TLD with the Clerk, 2415 S. Swanson St., Philadelphia., PA 19148, with a copy served on the applicant by September 24, 2012. Documents filed in support of the application are available for inspection at the TLD office (Contact Charles Milstein) between 9:00 a.m. and 4:30 p.m. Monday to Friday or may be inspected at the business address of the applicant. Re: Internal Revenue Service (IRS) Meeting Concerning Wheelchair Accessible Vehicles
Representatives from the IRS have agreed to explain the agency’s position on credits and tax deductions that may be available to those members of the industry who place accessible vehicles into service in Philadelphia.
The meeting will be held on June 20, 2012 from 10:00 AM until noon at the Pennsylvania Convention Center, located at 13th and Arch Streets, in Room 114. The room is accessible.

Notice to All Concerned: Fuel Surcharge
On April 23, 2012 the Board of the Philadelphia Parking Authority, at its scheduled April meeting passed a resolution requiring all medallion and partial rights taxicabs serving the City of Philadelphia to charge passengers a $1.25 per trip (not per customer) fuel surcharge, effective May 1, 2012. VTS and CMT are taking steps to automatically update the meters to include the $1.25 fuel surcharge as of 12:01 AM on May 1, 2012.
The partial rights taxicabs are responsible for having the surcharge placed on their meters by May 1, 2012 at 12:01 AM. Once that is done they are required to contact the TLD Enforcement Department to have their meters sealed.
The surcharge will remain in effect until midnight on Thursday May 31st, 2012. The June surcharge, if needed will be determined on Friday May 18, 2012 and posted on the TLD site. This process will be repeated monthly using the third Friday of each month as the determining date for the amount of the surcharge.
The Resolution also authorizes the Airport Transfer services to charge $2.75 per customer for trips to or from the Philadelphia International Airport, effective May 1, 2012 at 12:01 AM. The amount of each monthly surcharge will be posted on the TLD site in a similar fashion to the taxicab surcharge.

Attached is the Fiscal Year 2013 Fee Schedule for taxicab and limousine service providers regulated by the Taxicab and Limousine Division of the Philadelphia Parking Authority. The new fees go into effect on July 1, 2012.
